NCAA Bylaw 12.5.2.1 prohibits the use of a student-athlete's name or likeness to advertise, recommend or promote the sale or use of a commercial product or service of any kind. Interpretations have expanded this regulation to prohibit the use of nicknames which identify the student-athlete and the sale of autographed merchandise. The NCAA requires that member institutions take steps to stop the unauthorized use of a student-athlete's name or picture in order to protect the student-athlete's eligibility to participate in intercollegiate athletics.
Entities of The University of Mississippi and charitable and non-profit organizations may receive an exception to this prohibition provided the organization has signed an agreement with the University in which specific conditions are outlined. Products which contain a student-athlete's name or likeness may be produced and distributed by sources other than the University only if the product is distributed free to the public, the product contains no commercial advertising nor used for commercial promotions, and the student-athlete consents to the use of his or her name.
